Mr. Polinsky has focused his practice on disputes involving construction and real estate law.
In the area of construction disputes, Mr. Polinsky has engaged in all phases of construction litigation, arbitration, mediation and settlement. Functioning as lead, managing and co-counsel on multi-million dollar construction disputes, he has represented private and public entities, including the California Department of Water Resources, the California Department of Corrections, and the Los Angeles County Metropolitan Transit Authority. His cases include matters pertaining to power plants, correctional facilities, subway stations and tunnels, institutional and residential alterations, and residential earthquake damage projects.
Mr. Polinsky has handled matters involving such topics as construction delay/acceleration; lost productivity; unilateral contract modifications; disputed extra work; changed site conditions; construction defect; claims analysis; bid disputes; adequacy of design documents and approvals; responsibilities of owners, contractors, designers, inspectors, subcontractors, fabricators, suppliers and vendors; quality control; violations of California listing and licensing law; violations of Disadvantage Business Enterprise and Buy America requirements; violations of California False Claim Act and Unfair Competition Law.
In the real estate realm, Mr. Polinsky has represented private parties against various City and County agencies, in multi-million dollar suits involving breach of development agreements, inverse condemnation and nuisance actions.
Mr. Polinsky also worked for several years as in-house counsel and property manager for a property management company, with over 30 commercial centers in California, Nevada, Oregon and Washington, ranging in size from 20,000 to 250,000 sq. ft.
